Caerphilly County Borough Resident Prosecuted For Fly Tipping
A resident of Nelson has been prosecuted and fined for fly tipping offences following an investigation carried out by Caerphilly County Borough Council.
Mr Shaun Thomas of Heol-Y-Morien, Nelson has been prosecuted for breaching Section 34(1) of the Environmental Protection Act 1990, of not taking all reasonable measures to ensure that waste produced at P&S Auto Services was transferred to a person legally authorised to receive it. This resulted in waste being illegally deposited on land not authorised to receive it at Eglwysilan Common, Senghenydd/Nelson.
Thomas entered a guilty plea at Newport Magistrates Court on 28th October 2016. Following this, he was issued with a 2 year Conditional Discharge and ordered to pay costs of £527.56 and a £20 victim surcharge, to be paid at a rate of £100 per month.
Cllr Nigel George, Cabinet Member for Community and Leisure Services said: “Caerphilly’s Enforcement Team takes incidents of fly tipping very seriously, as illicitly dumped rubbish is a blot on our beautiful landscape, as well as causing an environmental hazard. All residents and businesses across Caerphilly county borough have a legal responsibility to ensure that household and commercial waste is disposed of in a legal and proper manner”.
He continued: “Anyone who does not follow the correct procedure risks being prosecuted and fined, even if they have not directly fly tipped themselves. Where incidents of fly-tipping are identified, our team will always seek to identify the owner of the deposited waste wherever possible so that further action can be taken”.
Offenders of fly tipping can face fines of up to £50,000 and/or imprisonment.
