Developer Fined For Building Regulation Offence
Newport City Council has successful prosecuted a developer who failed to apply for permission to carry out building work.
Asjad Ali Nekkavi, of Albert Terrace, Newport, pleaded guilty at Cwmbran magistrates’ court to an offence under the Building Act 1984.
He was fined £3,000, plus council costs, and a further £10 a day for every day the default continues.
Nekkavi built a two-storey building at the rear of 154 Commercial road with a garage at the ground floor and a flat on the first floor as well as rooms in the basement.
By law, the work required an application under the Building Regulations 2010 legislation.
A spokesperson for Newport City Council said: “The developer was asked on numerous occasions to resolve the situation but unfortunately he ignored advice from council officers and we were left with no choice but to prosecute.
“The regulations are there to ensure the health and safety of people in and around buildings. Mr Nekkavi had a total disregard for this and his sentence reflects the seriousness of the offence.
“He must now take the proper steps to regularise the situation or demolish the building otherwise the council will take further action against him.”
