£8,500 Fine Following Planning Enforcement Prosecution

In Caernarfon Crown Court on 17 March 2017, Mr Arwel Bryn Parry of Beudy Bach, Rhydyclafdy, Pwllheli, Gwynedd, received a fine of £8,500 following a recent planning enforcement prosecution by Gwynedd Council. ‌​‌​‌​​​‍‌​‌​​‌‌‌‍‌​‌‌​​‌​‍‌​‌‌‌​‌‌‍‌​‌‌‌‌​​

On 13 February 2017 in Caernarfon Magistrates’ Court Mr Parry pleaded guilty to one charge that on 2 August 2016 he had failed to comply with the requirements of a planning enforcement notice of 24 July 2013 in relation to land at Hendre Wen, Rhydyclafdy, Pwllheli, contrary to section 179(5) of the Town and Country Planning Act 1990. That notice was issued following an investigation by the Council which revealed that Mr Parry’s motor garage business, Moduron Arwel Parry Motors of Rhydyclafdy, is being run without appropriate planning permission. ‌​‌​‌​​​‍‌​‌​​‌‌‌‍‌​‌‌​​‌​‍‌​‌‌‌​‌‌‍‌​‌‌‌‌​​

In the first instance Mr Parry was fined £24,000 and ordered to pay a victim surcharge of £170 and Council legal costs of £350. Following Mr Parry’s appeal application, the Crown Court have changed the fine to £8,500. ‌​‌​‌​​​‍‌​‌​​‌‌‌‍‌​‌‌​​‌​‍‌​‌‌‌​‌‌‍‌​‌‌‌‌​​
