Councillors to Decide on Proposed Children’s Home in Tonypandy

Councillors are set to decide if the use of a Tonypandy house as a children’s home is lawful in planning terms.
The applicant is looking for a certificate of lawfulness for a proposed change of use of a house to a children’s residential home for up to two children, along with two support staff for 24 hours a day operating in shifts and a registered manager.
It looks to establish whether the plan would be lawful for planning purposes so whether it would result in a material change of use of the property or if it is capable of being carried out without the need for planning permission.
The application property is described in the planning report as a traditional mid-terrace dwelling located within a residential area of Tonypandy.
As the application seeks a decision on whether the proposed use is lawful, no consultation with nearby properties is needed or has been done, the report said.
A request was received from Councillor Gareth Hughes for the matter to come to committee for members to consider the application.
Council planning officers are recommending approval for the certificate of lawfulness having said that the proposal  is considered to result in a change of use.
But they said that based on the evidence and supporting information submitted by the applicant, the change of use would “not be considered material” so the development is lawful for planning purposes and planning permission is not required so a certificate of lawfulness can be issued. ‌​‌​‌​​​‍‌​‌​​‌‌‌‍‌​‌‌​​‌​‍‌​‌‌‌​‌‌‍‌​‌‌‌‌​​
